The board has often told you that the $26,400 they added to the budget in 2016 can be assessed by Flat Fee and not Percentage of Value because it's for cable. That's a lie.

From at least 2009 and thru 2015 (before the surcharge) and also in 2016, 2017 & 2018 (since the surcharge), you pay, I pay, every one pays $35 per month for cable. Co-owners who have been here a while will know that. $35 month from 55 units collects $23,100 per year. Since early 2016 the cable bill is $21,515 per year. Cable is paid for. The new Flat Fee assessment, the new $26,400 per year, the so-called "surcharge", isn't for cable. Not one dime. It has nothing to do with cable, it was for Building Repairs.

"The surcharge was a temporary patch to collect some money to start the much needed repairs." That's a quote from a January, 2018 email to me from Bonnallie. Or, from the minutes of the January 19, 2017 Board meeting: "Approximately $100,000 was spent in 2016 on the repair and maintenance of buildings exceeding the budget line by approximately $60,000. This shortfall was covered by a combination of underspending across other budget lines and the surcharge funding."

The falsehood that they are propounding - we may lawfully collect the new $78,000 by Flat Fee, because it's for cable - is the ugliest part of this whole affair. It's a stupid lie and easily refuted. Beginning in 2016, they billed you an additional flat $40 per month. Add that to the $35 you already pay and that makes the flat fee portion of your dues $75. But the cable bill declined to about $33/month at the same time they increased the flat fee part to $75/month then falsely told you (and the 47th District court) it was for cable. That was an intentional and devious mis-representation of the budget and assessment process. It's really, really, really bad. The board needs to be admonished because it is mandatory that they be truthful about Wynset finances.
